Who Can Apply?
Canada’s Caregiver Programs are for foreign nationals who wish to be employed by a Canadian citizen as a caretaker/nanny for their children or someone with disabilities in the home. This would provide a direct pathway to permanent residence. After just two years of experience with the Caregiver work permit, foreign nationals are able to apply for permanent residence.
The spouse and dependent children will accompany the Caregiver. The spouse gets Spousal Open Work Permit and children under 22 years of age get a visitor visa which can visitor visa or study permit.
There is more flexibility to change employer, as the work permit is issued to Caregiver is not an employer specific, rather it is occupation specific.
While applying for PR, if a Caregiver is in Canada and their family member are outside Canada, the Caregiver can request for a parallel PR application processing at a visa office of their country and at a visa office in Canada.
Eligibility Criteria
There are two stages to become eligible for work permit and PR under Caregiver program:
Stage 1: When you are not yet in Canada, your employer has to give you a job offer and you also have to meet the federal eligibility criteria like ECA of your post secondary education of at least one year and language test scores of at least CLB 5, Inadmissibility assessments like medical, criminality etc. First you will go to Canada on a work permit and start working for the same employer who offered the job of Home child care provider or Home support worker to you.
Stage 2: Once you complete two years of full time work experience in Canada (with a single employer or with multiple employers), your Work Permit status will be updated and PR is conferred to you automatically. During the first two years on work permit, you should not be absent from Canada, should not take long term leaves and should not stay unemployed and must work for at least 24 months out of 36 months validity period of your work permit. Â
Your employer can only hire you as a caregiver through this program if:
To give job offer to someone who is outside Canada: The employer should give you a job offer that shows that the caregiver has agreed to live in your home. Previously Labour Market Impact Assessment (LMIA) report was required for offering a job to someone from outside Canada, but now LMIA is exempted.
To give job to a caregiver who already has a work permit in Caregiver Program and who is looking for a new employer, the employer can simply hire without much hassle.
