PRTD, Inadmissibility and TRP

PRTD- Permanent Resident Travel document

It is an electronic paper issued to Permanent Residents of Canada who lost their PR card and wants to come back to Canada. It is a one-time permission that allows a PR to enter Canada and apply for a new PR card.

Embassy Immigration can assist you in case of such emergencies when you have inadvertently lost PR card and wants to obtain PRTD within time to travel to Canada.

Inadmissibility and TRP

Individuals who are found to be inadmissible to Canada can apply for a Temporary Resident Permit to overcome their inadmissibility and be allowed entry into Canada on a temporary basis.

There could be various reasons due to which a Foreign National can be inadmissible in Canada like Misrepresentation, Criminal Inadmissibility Medical Inadmissibility, Organized Crime, Committed human or international rights violations, and Security Risk.

A TRP grants an individual’s legal entry to Canada for a certain period of time, despite the fact that the individual is in fact inadmissible. It can be valid for as short as a couple of days up to a maximum of three years.

A TRP can be applied for at any point. Unlike criminal rehabilitation, a TRP is not subject to a certain time frame in relation to the completion of the sentence. An individual can in fact be granted a TRP while still serving a portion of his or her sentence in certain circumstances.

In deciding whether or not to issue a TRP, a Canadian Immigration Visa Officer will weigh the inadmissible person’s need to enter or remain in Canada against the health and security risks to the Canadian population. Applicants must be able to demonstrate that their entry into Canada is justified, no matter how minor the reason for inadmissibility may seem.

What crimes make you inadmissible to Canada?

To apply for a TRP, you will need to submit an application with the supporting documents explaining the reason behind your inadmissibility and why your entry into Canada may be justified. If you are a citizen of a visa-exempt country, you will need to apply based on the guidelines set out by your specific country as the application form may be different.

Temporary Resident Permit vs. Temporary Resident Visa

Individuals interested in travelling to Canada can sometimes confuse a Temporary Resident Permit with a Temporary Resident Visa. A TRP allows someone who is otherwise admissible to Canada, such as a USA citizen or resident, to overcome health or criminal inadmissibility so they can hopefully cross the border successfully. A TRV is a document required of people who are not from visa-exempt countries, such as individuals from China or India, in order to be permitted entry into the country as a tourist. It has no association with DUI entry into Canada.

While the Temporary Resident Visa application (form IMM 5257) can appear to be almost the exact same as the TRP application (form IMM 1444), and the names are obviously confusingly similar, Americans who want to go to Canada with a DUI conviction should be considering a Temporary Resident Permit (TRP) application not one for a Canadian visa.

Application Procedure

Applying for a Temporary Resident Permit requires that a person proves the necessity of their trip to Canada. Application procedures vary depending on the country someone is applying from. Canadian visa offices in each country will have information on their requirements. Each TRP application has a non-refundable $200CAD application fee.

Applying for a Canadian Temporary Resident Permit is a complex legal procedure. It is not possible to apply for a Canada TRP online; applications must be either mailed away or submitted directly by an “authorized representative” of Immigration Canada such as a Canadian TRP lawyer.

Can I work with a TRP?

As a TRP holder you and your family members can also apply for other services, such as a work or study permit. You can apply for a work or study permit separately from your application for another TRP or you can apply for both services together.
